Skutla ehf., kt. 6112090530, (“Skutla”) provides the service of renting electric scooters through Skutla’s mobile application. The Scooters can only be rented out to customers who have registered via Skutla’s app (“registered user” or “you”). These terms and conditions govern your use of Skutla’s services, as further defined in Chapter 1.
Please read these terms and conditions carefully, as they stipulate how Skutla will provide its services to you. As a condition of using our services, you agree to comply with these terms and conditions.
Skutla reserves the right to amend these terms and conditions at any time. The revised version will be effective when posted on our website or otherwise made available to you.

In these terms and conditions, the following words, terms and phrases have the following meaning:
2. REGISTRATION
In order to use the Services, you must register an account with the Skutla App. You must be at least 18 years of age to register an account and use the Services.
Please follow the instructions given during the registration process and provide accurate information. By registering for an account, you confirm that all information provided is accurate. You must further keep up to date the personal data which you provide during the registration process. This applies in particular to your email address, mobile phone number and payment details.
You may not provide your login details for use by other persons. Should any person other than you use your account, you will be responsible for such use. If you become aware of the risk that someone else is using your account or could use your account, you shall inform Skutla as soon as possible.
If Skutla becomes aware that any information you have provided is incorrect, or if someone else is or may be using your account, Skutla has the right to suspend or terminate your account and access to the Services with immediate effect.
3. USING THE APP AND OUR SERVICES
Skutla shall provide you with the opportunity to use the Skutla App in order to find, activate, use and deactivate a Scooter, if a Scooter is available. Available Scooters are displayed in the Skutla App. To use the App, you must have a compatible mobile device capable of running the App.
Only the registered user may use a Scooter that is rented via the App. When renting and using a Scooter you must comply with all of these terms and conditions, and in particular the provisions on safety and compliance with laws.
You must be capable of riding a Scooter and of sufficient physical fitness. You may not use a Scooter if you are under the influence of alcohol or any other substances or medications that may impair your ability to safely ride and control the Scooter.
The Scooters are only suitable for users who weigh 136 kg or less. Use by users above that weight may lead to injury or damage.
By renting a Scooter you confirm that you meet these requirements.
You may only use the Services solely for personal transportation purposes and as permitted by these terms and conditions.
The Scooters are only intended for use on firm, level surfaces, with both wheels in contact with the ground at all times. Riding a Scooter on other surfaces or through water is not permitted and may cause injury or damage. Riding a Scooter off a jump or doing tricks on the Scooter is not permitted and may cause injury or damage.
You acknowledge that other use of the Scooters, including but not limited to re-selling, sub-leasing, commercial activities or illegal or unethical activities, is strictly prohibited. You may not in any way use the Services for different purposes than those stipulated in these terms and conditions.
Scooters may only be ridden and used within the Operational Zone. You may not in any circumstances take a Scooter out of the Operational Zone, and Skutla reserves the rights to charge you for all costs of retrieval or replacement of the Scooter if it is removed from the Operational Zone.
Skutla may make changes to the Operational Zone from time to time, either temporarily (for instance due to an event or traffic restrictions within the Operational Zone) or permanently. Skutla may also impose restrictions on parking and speed limits within certain parts of the Operational Zone, either temporarily or permanently.
The availability of Scooters may vary depending on factors such as location, demand, and maintenance requirements. The App will indicate the availability of scooters in real-time, but Skutla does not guarantee the availability of Scooters at all times or in all areas.
The Scooters require battery charging to operate. It is your responsibility to be aware of the level of charge power in the Scooter you are using and to choose a Scooter with sufficient battery level for the intended ride. While Skutla aims to ensure that Scooters are charged regularly,Skutla cannot guarantee that the Scooter you use has enough charge power to reach your intended destination.
You must not park the Scooters in restricted areas, such as private properties, pedestrian walkways, entrances/exits, or obstructing public access.
You must return the Scooters in the same condition as when they were rented, with the exception of battery level, in an upright position, ensuring that they are parked safely and not causing any obstruction to pedestrians, vehicles, or public infrastructure. You must not park or fasten the Scooter in any way that prevents Skutla or another user from being able to use the Scooter.
4. COMPLIANCE WITH TRAFFIC LAWS AND REGULATIONS
When using a Scooter you agree to operate it in a safe and responsible manner, obeying all applicable traffic laws and regulations in the Operational Zone, including any temporary regulations that may be in place in any parts of the Operational Zone. This includes riding in designated areas, respecting pedestrian rights of way, and adhering to speed limits imposed by local regulations.
You are solely responsible for all penalties and fines that may result from your failure to comply with any traffic laws and regulations when using a Scooter. If Skutla is charged any penalties or fines arising from your use of a Scooter, Skutla reserves the right to claim reimbursement of those penalties or fines from you, together with Skutla’s costs incurred in collection from you.

5. SAFETY
You are responsible for your safety when using the Services. You are responsible for assessing the weather and riding conditions and making your own determination as to whether you are capable of operating the Scooter in the conditions.
You are responsible for wearing suitable clothing and protective equipment when using a Scooter. It is strongly recommended that you wear a helmet when using a Scooter, and you are responsible for providing your own helmet if you choose to use one.
You acknowledge that Scooters are intended for single riders only. Carrying passengers or cargo on the Scooters is strictly prohibited. When using the Scooter you should keep both hands on the handlebars at all times.
You are responsible for inspecting the Scooters before commencing your ride. As well as inspecting the condition of the Scooter generally, you should in particular that the tires are in good condition and that the brakes and lights work before you use the Scooter. If any damages or issues are identified, you must report them immediately through the App and you should not use the Scooter.
6. DAMAGES AND LIABILITY
You acknowledge and agree that they assume all risks and liabilities associated with the use of the Scooters. Skutla is not responsible for any injuries, accidents, damages, or losses incurred during the rental period.
If you have an accident or collision when using the Scooter, you must report it immediately to Skutla. You are also responsible for notifying the police and filing a police report if you have an accident or collision that causes any injury and/or property damage.
Skutla maintains insurance coverage for the Scooters, subject to the terms and limitations of Skutla‘s insurance policy. To the extent that you cause damage as a result of your use of a Scooter, whether to persons or property, you may be responsible for any deductibles or damages not covered by the insurance.
7. PAYMENT
You agree to pay the rental fees as determined by Skutla and displayed on the App. Skutla reserves the rights to change its rental fees from time to time, as well as to implement dynamic pricing; the applicable rental fees shall be the fees displayed in the App at any given time. The rental fees are generally calculated based on the duration of the ride and charged on a pay-per-ride basis. Each rental will only end when the Scooter has been validly parked and the rental has been ended via the App.
Additional charges may apply for extended rental periods, or any additional services provided by Skutla.
Payment for the Services will be processed through the App using the available payment methods, as registered in the App. By using the Services you authorise Skutla to charge the provided payment method for all applicable fees.
You may also be required to provide a refundable deposit as security for any potential damages or violations during the rental period. The deposit will be refunded within a reasonable timeframe after the end of the rental, subject to compliance with these terms and conditions.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Skutla and its affiliates shall not be liable for any damages arising from or in connection with the use of the Services, including but not limited to personal injury, property damage, or loss of data.
Skutla makes no representations or warranties regarding the availability, reliability, or accuracy of the Services or the content provided through the Services. The Services are provided on an "as is" and "as available" basis without any warranties, either express or implied.
9. PROPERTY AND IP RIGHTS
The Scooters are the exclusive property of Skutla. All intellectual property rights related to the Service, including the App and any associated software, logos, trademarks, and content, are the property of Skutla or its licensors. You agree not to copy, modify, distribute, or create derivative works based on the Service or its components without prior written consent from Skutla.
10. PRIVACY
Skutla values the privacy and security of your information. By using the Services, you acknowledge and agree to the collection, use, and disclosure of your personal data as described in the Privacy Policy.

11. TERM AND TERMINATION
Skutla reserves the right to terminate or suspend your access to the Services at any time and for any reason, including but not limited to a violation of these terms and conditions or misuse of the Services.
You may terminate your account and discontinue using the Service at any time by contacting Skutla or through the functionality provided in the App.
12. RIGHT OF WITHDRAWAL
You understand that performance of the Services has begun upon rental of our Scooters. By starting a rental you expressly confirm that the performance of Skutla’s services begins, and you acknowledge that you lose your right to withdrawal when the Services are provided in accordance with Art. 18(1) of Act No. 57/2005.
13. GOVERNING LAW AND DISPUTE RESOLUTION
These terms and conditions shall be governed by and construed in accordance with the laws of Iceland without regard to its conflict of law principles.
Any disputes arising out of or relating to these terms and conditions shall be resolved through good faith negotiations between the parties. You can also submit disputes to the European Online Dispute Resolution (ODR) platform, at https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.
If a resolution cannot be reached amicably, the dispute shall be submitted to the District Court of Norðurland.
